Terms of Service

Summary

  • Only authorized PWFL federation/club personnel may hold accounts.
  • Data entered must remain accurate, lawful, and limited to competition operations.
  • The service is hosted and monitored by Obsidian Corps under strict security, but you retain data ownership.
  • Breaches of acceptable use may result in suspension without refund.

These Terms of Service ("Terms") govern your access to and use of the PWFL Nominations platform (the "Service"), operated by the Powerlifting & Weightlifting Federation Luxembourg (PWFL). By registering for an account or using the Service, you agree to these Terms.

1. Eligibility

You represent that you are authorized to act on behalf of the organization or club you register and that you have authority to enter into these Terms. You must be at least 16 years old or the age of digital consent in your jurisdiction.

2. Accounts and Roles

  • Account owners are responsible for maintaining accurate information and securing login credentials, including two-factor authentication where enabled.
  • Roles (e.g., super admin, competition admin, coach/manager/delegate) define access permissions. You must grant access only to authorized individuals.
  • You are responsible for all activity under your account, including data entered for athletes and competitions.

3. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or to violate competition regulations.
  • Upload or transmit malicious code, disrupt the Service, or attempt unauthorized access.
  • Submit personal data beyond what is necessary for competition administration, especially sensitive health data unless required and lawfully permitted.
  • Misrepresent athlete eligibility or falsify competition records.

4. Data Ownership and Processing

  • You retain ownership of the data you submit. You grant PWFL a limited license to store, process, and display that data solely to provide and improve the Service.
  • We process personal data according to our Privacy Policy, which forms part of these Terms.
  • You are responsible for providing any required notices or consents to athletes and staff whose data you enter into the Service.

5. Service Availability & Hosting

  • The Service is hosted and operated by Obsidian Corps on managed infrastructure with redundancy and monitoring.
  • We aim for high availability but do not guarantee uninterrupted access. Planned maintenance or unforeseen outages may occur.
  • We may modify, suspend, or discontinue features with reasonable notice when feasible.
  • Incident response and communication timelines follow the escalation procedures outlined in the Privacy Policy.

6. Payment

If the Service involves paid plans:

  • Fees, billing cycles, and refund policies will be communicated during purchase.
  • Late payments may result in suspension or termination of access.

If the Service is free, we reserve the right to introduce paid tiers in the future with prior notice.

7. Confidentiality & DPAs

We treat your confidential data with care and implement security measures described in the Privacy Policy. You agree to keep platform credentials and administrative details confidential.

If your organization requires a Data Processing Agreement or bespoke confidentiality terms, contact [legal@example.com] so we can countersign before onboarding additional data subjects.

8. Intellectual Property

  • The Service, including design, code, and trademarks, is owned by PWFL or its licensors.
  • You may not copy, modify, reverse engineer, or create derivative works except as explicitly permitted.

9. Termination

  • You may terminate your account at any time by contacting support or using the available tools.
  • We may suspend or terminate accounts for breach of these Terms, misuse, security risk, or legal compliance.
  • Upon termination, we may retain data as described in the Privacy Policy for legal or backup purposes.
  • Federations that require controlled data export prior to deletion must request it within 30 days of termination.

10. Disclaimers and Limitation of Liability

  • The Service is provided "as is" without warranties of any kind, except as required by law.
  • To the maximum extent permitted, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability for any claim is limited to the fees paid in the 12 months preceding the event giving rise to the claim (or €0 if the Service is free), unless otherwise required by law.

11. Indemnification

You agree to indemnify and hold PWFL harmless from claims arising from your use of the Service, data you submit, or breach of these Terms, except to the extent caused by our own negligence or willful misconduct.

12. Governing Law & Disputes

These Terms are governed by the laws of Luxembourg. Parties will attempt to resolve disputes amicably before resorting to courts or arbitration. Mandatory consumer rights in your jurisdiction remain unaffected.

13. Managed Services & Support

  • Platform updates, backups, and infrastructure monitoring are delivered by Obsidian Corps. Their acceptable use policies apply to all customers.
  • Standard support is provided via email with responses targeted within 2 business days. Priority support requires an enterprise agreement.
  • Feature requests and roadmap previews may require a separate advisory contract.

14. Changes to the Terms

We may update these Terms from time to time. We will notify you via the platform or email of material changes. Continued use of the Service after changes take effect constitutes acceptance.
